National Commission For Backward Classes
As an important Indian statutory body, National Commission for Backward Classes was formed on August 14, 1993 to maintain the equal social order of the country. Formation of this Commission was meant to follow rules and regulations defined by the National Commission for Backward Classes Act, 1993. Supreme Court judgment of Mandal case was driving force behind the formation of this Commission.
About National Commission for Backward Classes
With the establishment of National Commission for Backward Classes, the Indian government selected five members including Commission chairman to head it. It was clearly indicated that the chairman would be a person from the judiciaryâ€”and a judge of the Supreme Court or any High Court.
Rest members of the National Commission for Backward Classes would be four important members out of which two would be social scientist while the rest two are those being recognized as experts who many have attained special knowledge of the matters pertaining to the issues of the backward classes.
Member cum Secretary post was created for whose appointment it has been clearly defined that a person should be a Central Government Officer of the Secretary to the Government of India rank. Commission members term has been fixed for the period of three years.
National Commission for Backward Classes was formed by keeping of view multiple roles which the Commission was assigned to play of its capacity. One important role which this Commission was assigned to look into was cases of all sorts of inclusions or exclusion of castes and their details for fresh notification of backward classes. It was mainly to bring maximum consistency into the job reservations as well as to maintain thorough transparency of tender issuance.
Appointed by the president of India, all five members of National Commission for Backward Classes work as a team and they are clearly indicated the grounds on that Commission would have to work. This Commission keeps suggesting to the Central Government on the matters of bringing transparency of the jobs and equal distribution of rights for social order.
Composition & Action of National Commission for Backward Classes
National Commission for Backward Classes was formed as a historic step when the Supreme Court was dealing with Mandal Case and judgment had just arrived. The Indian Government took steps to enact the National Commission for Backward Classes Act, 1993 to framework a National Commission for Backward Classes setup for which Commission members were appointed. Although tenure of each such Commission team is for mere three years but it remains a permanent body at the center with appointment of Commission members on the regular intervals.
With the Act coming into effect on April 02, 1993, the establishment of National Commission for Backward Classes was already smoothened. It is clearly explained of the Section 3 of this Act that newly formed Commission would have the multiple roles to play with a team of five key members out of which one would be the chair of Commission and the rest four to framework the works and allocations concerned.
Some of the important factors which the government of general and the president of particular takes into consideration to appoint Commission members include:-
- Appointment of only those specialist members who are deemed suitable of all respects to investigate for specific grounds on the basis of which such step is taken to setup Commission
- Potential Commission members are advised to investigate the causes of the social and educational backward of masses of India and to suggest a proper guideline with appropriate solution
- The Commission must point out the difficulties which the Central Government or any of its states face of terms of social disorder for better improvement of the condition of masses concerned
- The Commission would suggest for the grants to offer to a certain section of the society after clear evaluation of their needs to fulfill
Once appointed, National Commission for Backward Classes took the initiative to investigate various matters pertaining to the backward class masses. It presents the report to the president with the appropriate recommendations. Once received the president forwards the report to both the houses of parliament to discuss and implement that accordingly.
Implementation of Recommendations
National Commission for Backward Classes plays pivotal role to ensure social order is maintained of India for that it keeps examining requests of all the communities to include or being not included of backward classes lists after the proper judgment. It also suggests the Central Government whether such requests are doable or not.
National Commission for Backward Classes has been reconstituted on many stages upon finishing respective terms. They included subsequent reconstitutions on the dates 28.2.1997, 28.7.2000, 24.3.2002, 13.8.2002, 14.8.2006 and 7.6.2010 respectively.
